Terms of Service

These are the rules for using Laps. They are a real contract between you and us, so they are written to be read rather than skimmed past. The parts that matter most are section 10 on swimming safely, section 7 on what you pay for Laps Pro, and section 13 on what we are and are not responsible for.

1. The agreement

Laps is operated by an individual based in the Netherlands, named in section 16. "We", "us" and "Laps" mean that operator. "You" means you.

By creating an account or using the app you agree to these terms. If you do not agree to them, do not use Laps.

Our Privacy Policy explains what we do with your data and forms part of this agreement.

2. Who can use Laps

You must be at least 16 years old. There is no version of Laps for younger swimmers, and we will delete an account we learn belongs to someone under 16.

You must also be able to enter a contract where you live, and not be barred from using the app under any law that applies to you.

Your swims, titles, descriptions, photos and bio remain yours. We do not claim ownership of any of it.

To be able to show it to the people you chose, you give us a non-exclusive, worldwide, royalty-free licence to store, display and distribute it inside Laps, for as long as you keep it posted. That licence exists only to run the app. It ends when you delete the content or your account — except for copies that remain in backups for a short time, as described in the Privacy Policy.

Only post what is yours to post, and make sure anyone recognisable in a photo is happy to be there.

We may remove content and suspend accounts that break these terms. Where it is reasonable to do so, we will tell you why. You can reply to us at help@laps-app.com and we will look again.

6. Fair ranking

The leaderboard is the point of Laps, so this section is not decoration.

Laps scores against the World Aquatics points tables. We are not affiliated with, endorsed by, or connected to World Aquatics in any way. Their tables are republished periodically and a score is only ever as current as the table it was calculated from.

7. Laps Pro

Laps is free to use. Laps Pro is an optional subscription that unlocks your full points history, the training plans, rank projections and the regional leaderboard. Global and friends leaderboards, streaks and personal bests stay free for everyone.

Price and billing

Cancelling

You can cancel at any time, and cancelling is done in the App Store or Google Play, because those are the only places that can stop a subscription. The app takes you there.

Cancelling stops the next renewal. You keep Laps Pro until the end of the period you have already paid for, and it is not refunded pro rata for that remainder.

Refunds

Refunds are handled by Apple or Google, under their policies, because they took the payment. We cannot issue one ourselves. If something has gone wrong, email help@laps-app.com anyway — we will help you sort it out with them, and this does not affect any right you have under consumer law.

Price changes

If we change the price of an existing subscription we will tell you in advance, through the app or by email, and you will be able to cancel before it takes effect. Where the store requires your explicit consent to a change, your subscription will not renew at the new price without it.

8. Your right to change your mind

As a consumer in the EU you normally have 14 days to withdraw from a distance contract for digital services, without giving a reason.

Because Laps Pro starts working the moment you subscribe, you are asked to agree that it begins immediately — and by doing so you acknowledge that you lose that 14-day right once the service has been fully performed. This is how Article 16(m) of the Consumer Rights Directive works, and it is why the store asks you to confirm.

In practice, Apple and Google both operate their own refund processes that are often more generous than this. Start there, and write to us if you get stuck.

9. Availability and change

We want Laps up all the time, but we do not promise it. It may be unavailable for maintenance, because something has broken, or because a service we depend on has.

Laps will change. Features may be added, altered or removed. If we remove something significant that Laps Pro subscribers pay for, we will tell you, and you will be able to cancel.

If we ever discontinue Laps entirely we will give reasonable notice, stop charging, and leave you time to export your swims.

10. Swimming is your responsibility

Laps is a scoring and social app. It is not a coach, and it is not a medical device. Nothing in it is medical advice.

The training plans are general content written for healthy adult swimmers. They are not tailored to you, they do not know your health, and they are not supervised.

Talk to a doctor before starting or changing a training routine, particularly if you have any medical condition, are pregnant, or are returning from injury.

Never swim alone, never swim beyond your ability, and never swim somewhere unsupervised or unsafe. Chasing a streak, a personal best or a place on a leaderboard is never a reason to take a risk in the water. Stop if you feel unwell.

You are responsible for your own safety when you swim. To the extent the law allows, we are not liable for injury, illness or loss arising from swimming or from following a training plan.

11. What belongs to whom

Laps — the app, its design, its name, its logo and its mascot — belongs to us and is protected by copyright and trade mark law. These terms give you permission to use the app on your own devices, personally and non-commercially. They do not give you any ownership of it.

Do not copy, adapt, redistribute or resell any part of Laps, and do not remove any notice of ownership from it.

Your content stays yours, as section 5 says.

12. Ending it

You can leave whenever you like. Settings → Account → Delete account really deletes your data — see the Privacy Policy. Remember that deleting the app does not cancel a subscription: cancel that in the App Store or Google Play first.

We may suspend or close an account that seriously or repeatedly breaks these terms, or where we must for legal reasons. Except where it would be unlawful or unreasonable to do so, we will tell you why and give you a chance to reply. If we close a paid account without good reason, we will refund the unused part of it.

13. What we promise, and what we do not

Laps is provided as it is. We do not promise it will be uninterrupted or error-free, that a score will always be right, or that it will suit any particular purpose you have in mind.

Nothing in these terms limits liability that cannot lawfully be limited. That includes death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and any right you have as a consumer under mandatory Dutch or EU law. If you are a consumer, your statutory rights are unaffected by anything here.

Beyond that, and so far as the law allows: we are not liable for indirect or consequential loss, for lost data where you could reasonably have kept your own copy — Laps lets you export your swims — or for loss caused by something genuinely outside our control. Our total liability to you in any twelve-month period is limited to the greater of the amount you paid us for Laps Pro in that period, or €50.

14. Law and disputes

These terms are governed by the law of the Netherlands, and disputes may be brought before the competent courts of the Netherlands.

If you are a consumer living elsewhere in the EU, this does not take away the protection of your own country's mandatory consumer law, and you may bring a claim in the courts where you live.

Please write to help@laps-app.com before anything formal. Almost everything is quicker to fix that way.

15. Changes to these terms

We may update these terms — because Laps changes, or because the law does. The date at the top says when they last changed.

Where a change materially affects your rights we will give you reasonable notice in the app or by email before it takes effect. If you do not accept a change, you may stop using Laps and delete your account; if you had a paid subscription, you may cancel and we will not make you take the change mid-period.

If any part of these terms turns out to be unenforceable, the rest of them still stand.
